Residency and state taxes while OCONUS
How does this work? If I have a job in Japan, will I be paying CA state income taxes on it?
Also, is there a way I can legally establish residency in another state for when we get back? What would i need in order to make that happend? My parents live in Nevada (which has no state income taxes). If DH and I (now that the spouse residency bill is about to become law) could somehow establish residency there, it would be awfully nice when we get back not to have to pay state income taxes. |

I know that for active duty stationed overseas do not pay CA income tax. It's still taken out but at tax time we get every dime refunded.
As far as establishing residency you need to have a physical address in order to do that so if your parents are in NV and you want to make their address your residence then you can do that but I think you need to be there in person to get the drivers license/state ID card in order to establish your residency. Not sure about that, though, it just seems logical. |

Is it legal to use a parents address? I could tim eit so that it was after I move from here but before we go to Japan, or after Japan but before we find a place at our new duty station, so technically, I wouldn't really have a home of my own at that point. It would be easier to just do it when convenient, but I am worried about the legality.

We have a home in MO but my husband claims MS has his home state and uses his parent's address. Since he's military it's ok. The bad part is that when it comes time to renew the car tags, it gets sent to his parents house instead of ours and his parents will have to mail it to us. Just a hassle. Also sometimes MS messes up my state tax. They always bill me even though I pay MO taxes because I work in MO.

http://www.military.com/Finance/cont...,85041,00.html You also wouldn't file CA state taxes with Japanese income. |
