If a military personnel such as an enlisted person or officer, commits a murder on a civilian, should they have to appear in a military court or in a civilian court or both?

um well since they are "owned" by the militray then i think military courts

depends on where the murder happened. if it was on/in government property, then the military. if it was civilian than civilian

Well, lets flip it..if a civilian murders a military memeber..should they be tried in military court? I dont know..I think if you commit murder, you should be tried in whichever one has the stiffist penalties

i'll agree to that. -the death penalty. i just dont like it

Well, this actually happened on my husband's deployment. One of the sailors got really drunk in Scotland one night and tried to kill a prostitute. They were only going to be there for 6 days but ended up staying over a week because they were trying to see if they could bring him back and try him in the states but they wouldn't let him leave the country because he committed the crime there and it was with a civilian so the locals are taking care of it.
While his trial or whatever came up they sent him to London to work for the base there because the base in Scotland isn't American or something. We just found out he got 2 years in a Scottish prison for it.

I have to agree with the situation your fellow friend was dealt. He was in a foreign country and we (as Americans) our guests in a foreign land whether military or not and should conduct ourselves as such. He doesn't deserve the right to come back to the states and have the situation downplayed. I don't know for sure this would be the case, but it could happen with the girl being in another country during a trial. Yes I know she could fly here but why should she, as the victim, have to endure more pain and trama.

I totally understand them wanting to keep him there, why should they have to cater to him when he committed the crime in their country. They're not going to care where he is from, they just want justice. I couldn't imagine having the victim follow the criminal to wherever he's from.

I think that they should go to civilian court, and also take responsiblity for whatever the military gives them. I'm not sure if that makes sense how I said it to you guys, but it made sense in my head ! lol
