    Confused BAH and Child support

    My husband and I have been married a little over a year now. He has a former spouse of whom he pays child support to. He is currently deployed and wants to modify his support when he returns but wants to make sure his BAH does not apply towards the modification. The last time it was modified we weren't married and it went towards the support (which was not a big deal at the time). Now that we are married and live in housing having to pay housing and support being calculated into the BAH that we don't see anyways will hurt. Does anyone know anything about BAH being calculated into support matters when its being used as its suppose to (on the family living in the housing)?

    Since you will be using the bah, his cs money will have to come out of the paycheck.

    he can also apply for BAH II ( sometimes called BAH Differential) to help offset the cost of cs.

    I just want to make sure before he applies for the modification that because we are using the BAH it wont apply towards the CS? He's coming home in 6 weeks and I rather not deal with all of this if we don't have to.

    It depends on state laws wether BAH will apply or not, but I beleive as long as you are living in housing and not actually receiving BAH it will not affect CS.

    first- depending on the state the child support order is in ( not the state you reisde in unless they are the same) - some states take ALL income earned by the member and his spouse- so if you are working they may take your income as consinderation also-

    if you are now recieving BAH even if it 100% goes BACK for housing they will mostlikely count it as income- same for BAS.


    secondly- if he is married he cannot and I repeat cannot collect BAH Diff- this is ONLY for unmarried members with dependants.
    he cannot collect 2 BAH rates.

    I know that here in Michigan my ex's bah was included when calculating what he had to pay. Didn't matter if he was using it or not, it was part of his income.

    We live in California, so far I found out that they can only count his base pay and BAH (dont know if it applies if he is using it), everything else doesnt apply ex; BAS, Hazardous pay, family seperation etc....I just have to find out if his BAH is excluded if he is using it. HELP ME....hehe

    Be careful though because if you're in PPV housing, you DO get BAH.
