    Help divorce & money

    If someone is going through divorce and they are legally separated, is the military member still entitled to BAH with dependents & family sep pay when they're deployed? Are they required to pay it back at any point? I have a friend who was suppose to have her divorce finalized this month & is now getting pushed back longer due to deployment.

    I'm married, never been divorced. DH and I are guessing and don't quote us, but we think since your friend is still 'legally' married, while 'separated'. That her soon to be ex husband (aka active duty service member) would still be able to derive BAH b/c of the legal marriage.

    My suggestion would be to call Legal to confirm. The JAG would know for sure. Hope that helps.

    Yes. Since they are technically still married, he can still pull BAH.

    yes, he will maintain ALL of his BAH until the divorce in final-

    and just a note here- that he will maintain if not all his BAH then some part of it as long as he has dependants.

    it is in the works to do away with the BAH differencial or BAH 2-- the reason is the military constantly stands by - a dependant is a dependant- but not with BAH-

    hopefully this will be finalized very soon.

    YES to the BAH! It should be included in the separation agreement. Everything should remain the same until the divorce decree is presented. I can tell you this from experience.

    I asked DH .. he pretty much confirmed what everyone said. Until she's off his page 2, he can collect what he wants & if she wants any of that money, she needs to put it in the decree.
