    eviction help

    Anyone ever had to evict a tenant before? Would love any help in this area. Basically we have a freeloading tenant who hasn't paid this month's rent and the prorated rent for June, but can afford to take trips, just not pay their rent. We're basically paying for housing here and the mortgage so they are basically living there for free.


    oh and if we have to fly out there from Hawaii, can we in turn sue her for the place tickets and rental car if we are just going there for this issue? Not worried about leave time nor the command, he's the top dog there so no issue there.

    I'd talk to an attorney. You definetly have grounds for an eviction but every state is different & evictions can get messy quick.

    Do you have to send them an eviction notice w/a 30 or 60 day notice?

    Best bet, contact the fair housing office for that city or a lawyer.

    When did they move in, how late are they on this months rent? I believe they have to be about 2-3 mths behind before you can do anything, but that all depends on the city and the rent agreement. Is there are reason they haven't paid? Have you spoken to them? How do you know they are taking trips?

    Its been pulling teeth trying to get them to deposits and stuff, so idk. i don't see us having any improvement on these people paying rent. And its been about a month and a half. yes, and we keep getting lame excuses. They called from a state across the country and said they couldn't make any deposits, that was on July 1st when dh asked if they would be paying the prorate rent that was never paid in June. i hope its not 2 to 3 months of the same crap.

    its not for Hawaii unfortunately, i think these people and their friends that talked us in to renting were banking on the fact that we wouldn't be able to do much if the deposits and rent were late. I have a feeling this was planned, idk, but karma is sweet.

    And I'm not sure Jayo, we were one day late on rental payments twice with two different property managers, both places were ready to evict us pretty quick and it definitely wasn't a 30 day window. The first place, uggh, would barely work with us but the second was really willing.

    The thing that gets us is we're been really wanting to work with these people but with us being out of country and supposedly people they know that knows dh they are telling her to feed him some excuses either to keep us from evicting them or whatever. its just crazy.
