If a pregnant woman is killed in the third tri.. Is it 1 murder or 2?

In the third tri, i'd definitely say 2.

i would say 2! The baby would be able to live outside of the womb...

2. As long as the baby would be viable outside the womb I call that murder/manslaughter/whatever the person is being charged for in regards to the mother.

i agree that it should be murder against the child too.

we had a case her local probably a year or 2 ago though, the lady shot herself in the stomach, killing her unborn child. she was charged but then aquitted, the judge dismissed the case. if i remember correctly because teh baby had never actually taken it's first breath they didn't consider it murder.

At any given trimester, it counts as 2. There is another human being inside throughout the whole pregnancy.
